Who Qualifies for Expungement in Wyoming?

Wyoming enacted an expanded expungement law in 2021 that extended eligibility to some felony convictions for the first time.

Who Qualifies

  • Dismissed / acquitted charges: 180 days after case close
  • Misdemeanor convictions: 5 years after sentence completion
  • Nonviolent felony convictions: 10 years after sentence completion
  • No new criminal convictions during the waiting period
  • All fines, fees, and restitution paid in full

Not Eligible

  • Violent felonies (murder, manslaughter, assault, etc.)
  • Sex offenses requiring registration
  • DUI convictions (generally)
  • Crimes against children
  • More than one prior felony conviction

Step-by-Step: How to Clear Your Record in Wyoming

  1. Obtain Wyoming criminal record — From Wyoming Division of Criminal Investigation (DCI).
  2. File petition — In the district court of the county of conviction. Fee: $100.
  3. Serve the county attorney — Has 30 days to object.
  4. Hearing — A hearing is held. The court considers whether expungement is in the interest of justice.
  5. Order issued — DCI and all agencies expunge records.
