Who Qualifies for Expungement in Idaho?

Idaho has very limited expungement options. True expungement of convictions is generally not available — the primary path is a "withheld judgment" entered at sentencing.

Withheld Judgment (Most Common Path)

  • If the court "withheld judgment" at sentencing (common for first offenders), you may petition to have the case dismissed after completing probation
  • Available for misdemeanors and some felonies at the court's discretion
  • Once dismissed, the record is treated as a non-conviction for most purposes
  • Must successfully complete all probation conditions

Arrest Record Expungement

  • If charges were dismissed, acquitted, or never filed — you may petition to expunge the arrest record
  • Available through the Idaho State Police

Not Available

  • Expungement of felony convictions where judgment was entered (no withheld judgment)
  • Sex offenses
  • Most violent offenses

Important: If you were convicted (judgment entered) without a withheld judgment provision, Idaho offers very limited record relief. A governor's pardon is an alternative path worth exploring for serious cases.

Step-by-Step: How to Clear Your Record in Idaho

Withheld Judgment Dismissal

  1. Complete probation — All conditions, fines, and restitution must be satisfied.
  2. File motion to dismiss — In the court that handled your case. The court reviews your compliance record.
  3. Order issued — If granted, the conviction is vacated and the case dismissed.

Arrest Record Expungement (ISP)

  1. Submit an expungement request to Idaho State Police Identification Bureau with documentation of dismissal or acquittal.
  2. ISP reviews and clears the record from the state database.

Waiting Periods

  • Withheld judgment: Upon successful completion of probation (no additional waiting period)
  • Arrest expungement: Upon case close (dismissed/acquitted)

Costs

  • Filing fee: ~$75 (varies by court)
  • Attorney fees: $500–$1,500

What Record Clearing Does (and Doesn't) Do in Idaho

After a successful expungement or sealing in Idaho, your record will generally be cleared from:

  • Most private employer background checks
  • Rental housing background checks
  • Most licensing board inquiries (varies by profession)

However, it typically does not affect:

  • Federal law enforcement and immigration records
  • Military background checks
  • Applications for law enforcement positions
  • Some professional licensing boards (law, medicine, teaching — varies by state)
  • Sex offender registry requirements (in most cases)
