Who Qualifies for Expungement in Alaska?

Alaska has limited record relief options. The primary path is a suspended imposition of sentence (SIS) granted at sentencing, or sealing of arrest records for non-convictions.

Suspended Imposition of Sentence (SIS)

  • If the court suspended the imposition of sentence (available for first-time offenders at court discretion), you may petition to withdraw your plea and dismiss the charge upon completing probation
  • Available for misdemeanors and certain low-level felonies

Arrest Record Sealing (Non-Convictions)

  • If charges were dismissed, acquitted, or not filed — the arrest record may be sealed
  • Petition the Department of Public Safety

Not Available

  • Most felony convictions (where SIS was not granted)
  • Sex offenses
  • Crimes of violence
  • Multiple prior convictions

Step-by-Step: How to Clear Your Record in Alaska

SIS Dismissal

  1. Complete all probation conditions.
  2. File a motion in the original court to withdraw the guilty plea.
  3. Court reviews and, if satisfied, dismisses the charge.

Non-Conviction Sealing

  1. Submit a petition to the Alaska Department of Public Safety.
  2. DPS reviews and, if eligible, seals the arrest record.

Waiting Periods

  • SIS completion: Upon successful probation completion
  • Arrest (no conviction): Generally after case close

Costs

  • Filing fee: ~$150
  • Attorney fees: $750–$2,500

What Record Clearing Does (and Doesn't) Do in Alaska

After a successful expungement or sealing in Alaska, your record will generally be cleared from:

  • Most private employer background checks
  • Rental housing background checks
  • Most licensing board inquiries (varies by profession)

However, it typically does not affect:

  • Federal law enforcement and immigration records
  • Military background checks
  • Applications for law enforcement positions
  • Some professional licensing boards (law, medicine, teaching — varies by state)
  • Sex offender registry requirements (in most cases)
